Control Centre Terms and Conditions
The following terms and conditions govern your use of the Site and contain warranty and liability disclaimers. Please read them carefully before proceeding to use the Site. By using the Site, you will be taken to have read, understood and accepted these terms and conditions in the same way as if you had signed a printed version, and they will continue to apply every time you use the Site. If you do not accept these terms and conditions, do not use the Site.
- The service web site with web address: http://controlcentre.pa-sport.com (the "Site") is owned and operated by PA Sport a division of The Press Association (registered in England under the number: 3891053) of PA NewsCentre, 292 Vauxhall Bridge Road, London SW1V 1AE (the "PA").
- The Site is at a 'beta testing' stage of development where selected users are offered use of the Site and the non-exclusive license to use, store and distribute the information contained on the Site in connection with their normal business activities at no cost. Such 'beta testing' period will be notified to users by the PA in writing but, in any event, any user's access to the Site may be terminated by the PA at any time.
'Beta testing' means that the service is not at the final stage of development and may not be the service which is marketed and branded 'Control Centre'. - PA Sport will not accept liability for any errors in or failures of the Site. PA does not accept any liability for any loss or other liability (direct, indirect or consequential) that might arise in connection with any user's use, storage, publication or distribution of any material which appears on the Site or any other liability that arises in connection with the user's use of the Site. However, nothing shall limit the PA's liability: (a) for fraud, (b) for death or personal injury caused by PA's negligence or that of its servants or agents, or (c) in relation to any other liability which cannot be excluded or limited by law.
- If any information from the Site is stored, published, distributed or otherwise used by any user in any way the "Actim" logo and any copyright attributions shall be used as it appears on the Site.
- The copyright (which term, for the purposes of these terms and conditions, shall include database rights) and all other intellectual property rights ("Intellectual Property Rights") in: (i) the services made available to you via the Site including, but not limited to, all software used on and/or forming part of the Site, and (ii) all content appearing on, or made available to you via, the Site including, but not limited to, photographs, graphics, images, captions attached to any photographs, graphics or images and any other text (the "Content") and the manner in which the Content is presented or appears on, or is made available to you via, the Site is the property of the PA or its licensors, and all rights are reserved. In addition, any names, images and/or logos appearing on the Site are proprietary marks of the PA or its licensors, and all rights are reserved.
- You acknowledge that the Intellectual Property Rights in certain software, services and other information forming part of the Services and the Content respectively may be the property of third parties, and each users agrees to be bound by any restrictions imposed by such third parties and/or any other relevant third party licensor(s) of the PA and to ensure that, where required by PA, copyright and/or other arrangements are made directly with such third parties.
- Each user agrees to provide feedback as part of this agreement to a member of staff or representative of PA Sport, who will not contact any user more than once a week. Such feedback to include comments on the usability and operation of the Site as well as the appropriateness of the service to their business. Subject to the user giving their prior approval, this feedback may be included within future PA Sport marketing material.
- Any details which any user provides to the PA from which the PA can identify you will be held and processed in accordance with the PA's registration under the Data Protection Act 1998. Further details are set out in our Privacy Policy.
- This Agreement shall be governed by and construed in accordance with English law and each of the parties hereby submits to the jurisdiction of the English courts.
